Amazon's White Background Patent and What It Really Means

Amazon's White Background Photography Patent

Alright, alright, alright. Everyone is up in arms about Amazon's recent patent 8,676,045 which covers their approach to photographing a person or product against a white background, usually used in a fashion spread or online shopping page. Even Stephen Colbert is shocked yet inspired to patent something that already exists. Business owners know all too well this adage, which was told to us by our lawyer at the time while we were going through a trademark issue: "Anyone can be sued at any time for any reason." Great. It was also during that time that we witnessed the art of lawyering, and how pushing paper can really rack up costs for a lawsuit, and help one side win, even if their argument is defies logic as we know it. Double great.

So it's to be expected that photographers and business owners are freaking out a little bit about this giant Amazon, who also owns a patent for one-click shopping and who last year completed a mysteriously unmarked building where they take massive amounts of fashion photography on white backgrounds, which now seems to own part of the white background production process (though hopefully not the DIY cardboard light box method!). It's not unusual that we may think that Amazon may want to crush online businesses one by one by eliminating their ability to take a photo on a white background.

That said, I'm going to take the more optimistic approach.  Surely Jeff Bezos, who claims that patent lawsuits are "not healthy for socieity", doesn't want to sue the small businesses who also probably sell on Amazon.

ATTENTION: Mr. Bezos, if you are reading, this is your invitation to please comment below that you have no intention of stopping photographers and business owners from taking photos on a white background using a platform for a model to stand on and blowout lighting and fancy lenses and your favorite F-stop!

Herein lies my hope: that Amazon has no intention of snuffing out online businesses, but only aims to cross its T's and dot its I's because they have a business model that sells the service of taking product photography on white backgrounds, and wants to lock in the look for their type of white backgrounds. According to Racked, who went in for an exclusive photo shoot of Amazon's Williamsburg-based photo studio in Brooklyn, models line up to be photographed for Amazon's shopping sites, Amazon Fashion, Shopbop and MYHABIT. Apparently they are doing big business - they have had sustained 20% growth since 2004, according to an analyst at Evercore who was quoted in Racked's article. 

According to the patent, it would not be simple to recreate their specific process. I'm not a photographer, so please, all you visual professionals,  chime in here and share your thoughts.  I'm hoping that this processes is truly just way too hard to replicate, and that the patent is just a formality. Right? Right??

#SmallBizProud: An Interview with Filmmakers Trisha and John

Usually the person behind the camera is silent, speaking only through the people on film. But this week we’re showcasing the incredible force behind the lens of Capital One Spark’s “I Am Small Business Proud” campaign: filmmakers Trisha Dalton and John Sears. These two are truly a dynamic duo and we’re in awe of their energy, creativity and work ethic. During their journey on the highways and streets of Buck StinsonAmerica, they are stopping in small towns and big cities to meet new faces of small businesses, courtesy of Capital One. Why is Capital One doing this? In the words of Buck Stinson, Senior Vice President for Spark: “As a leading financial resource for small businesses, we understand the value of getting close to our customers. This is a great way for us to capture a true representation of small business owners and celebrate what they do every single day.”

Trisha and John are on this journey across America to listen to and record stories first-hand as told to them by the business owner(s). They conduct the interviews and edit content to create one-of-a-kind video “portraits” that feel as real as if we sat down for a cup of coffee with the small business owners ourselves. And if that’s not enough, they also turn the camera on themselves to give us recaps of where they’ve been and share a behind-the-scenes look at what they love most about the towns and cities they visit. These two are amazing!

We interviewed Trisha and John to get the scoop on how they manage unexpected situations, their secret to getting business owners to open up and share their stories on camera, and what got them started on their own path as small business owners themselves. Trisha and John are all about hard work, passion, and major #smallbiz love; cheers to these two!

Tell us a little bit about your own small businesses as filmmakers.
We have both run our own film production companies since college, working regionally and nationally, specializing in personal story, social impact videos for personal interest as well as corporations and non-profits.
 
What would each of you say has been a highlight so far while you’re on the road?
Capital One Spark Business has given us the fantastic opportunity to travel around the United States and talk to local small business owners.  It has been a highlight to hear their stories.
 
Have there been any difficult situations where you had to “make work” on-the-fly MacGyver style?
Things have been going quite well so far but we don’t want to jinx ourselves!
 
How does a business tell you their brand story? What tips do you have for businesses translating their brand stories to you?
We have an easy time connecting with small business owners, because we are small business owners ourselves, and we spend time getting to know them before we turn the camera on, so that they feel comfortable sharing the stories of how they built their business and brand, and their passion that drives it.
 
When a small business pitched you, what stuck out that made one story more compelling to you to select as your video?
There are so many great businesses and stories behind them that it’s hard to choose.  We have tried to select a variety of types of businesses and stories.
 
As filmmaking partners, what habits and strategies do you employ to “make it work” so well on the road?
We make sure to listen to one another and have fun while we’re working.
 
How do you work as partners on the road? Does your work on set help you work together so closely on the road?
We are used to sharing responsibilities, and leaning on one another's strengths, and that has carried over into our road trip routine.
 
What kinds of connections or commonalities between people's stories are you finding as you interview people across the country?
All the small business owners we have met with have had an incredible work ethic - many of them work ’24/7', have a real passion for their business, and a strong sense of community - they all consider their community to be integral to the success of their business… It’s easy to see why small business is considered the heartbeat of America.
 
As you go from city to city, how much does the context of the place effect the small business you are profiling? Do you notice some towns to be more small biz friendly than others?
The small business owners we have met with are very community oriented, whether in a big city or small town.  We have seen strong communities everywhere we have been.
 
As small business owners yourselves, are you identifying with aspects of any of the short features coming out of the #SmallBizProud project? Filmmaking is usually associated with making art and telling stories, but what of your business building skills?
Partnering with Capital One Spark Business has given us the chance to meet so many business owners and broaden our network of individuals. We identify with many of their trials and tribulations, like long hours, and wearing many hats.  More than anything we have been inspired by their optimism, success, and  generous approach to their communities.
 
How are you able to make these mini-films on the road? Is one editing while the other drives?
Sometimes one person edits,  while the other drives, but we do most of the editing in local bed & breakfasts, and small business inn’s, where we stay along the way.

How to Prepare for Holiday Gift Guide Pitching

Strategies for planning for holiday gift guides in the summerIn real time we're just kicking into the summer season, but in the PR world, especially the "long lead magazines" (magazines that come out every month, and work about 3-6 months ahead of time) it's nearly time to begin pitching the holiday gift guides!  I KNOW!  It may be hard to get your mind into the holiday spirit when it's warm and sunny outside, but for buzz building success you have to get your business into winter mode pronto!

This week we'll be hosting a member #TuneUp sharing our #TinShingleTips that will get you pointed and rolling in the right direction, and early next week we'll have a full podcast revealing everything from "how to right the perfect holiday pitch" to "how to hunt down the magazine gift guide editors".  Until then, however, you have your work cut out for you.  Here are a few things you should begin working on this week (we're serious - this week) to get your pr campaign in holiday pitching shape.

HOW TO PREPARE FOR HOLIDAY PITCHING

  • Summer is the time to pitch magazines for holiday gift guidesGet your ducks in a row: This means figure out what your holiday offerings are and be sure you have high resolution images of them, get any product fact sheets or linesheets in order, make sure you have samples of everything you'll be pitching and so forth.  You cannot tell an editor "it will be ready come holiday season" when pitching them.  Whatever you want to offer for their gift guides must be ready when you pitch them.
  • If you are an expert, get your holiday tips and story ideas ready.  Whether they be holiday travel safety tips or healthy "swaps" for favorite holiday snacks, you need to have a bulleted list of ideas that match the outlet you're piching them to.
  • Prepare a media tracking sheet you can use specifically for your holiday outreach.  Often the editors you'll be reaching out to are not the same people who cover your normal beat, so you may need to make some new relationships.  Also, keeping this list separate from your usual outreach list keeps things clean and organized, which leads to faster and more precise outreach to magazine editors.
  • Do some research.  Check out what your target outlets covered in the past to get a vibe for how they "do holiday".  Sure they may change their tactic completely this year, but checking out past holiday gift guides (you can often find these online) will help give you an idea about what their demographic and editorial team are interested in, product wise.
  • Finally - and most importantly - make a buzz building game plan now.  Set aside time in each week to meet your prep goals and actual outreach goals.  The holiday pitch cycle runs through end of August and you want to be sure that you are keeping time open in your schedule to make it happen.  This is definitely a case of early birds getting the worm, so making it a priority will help ensure you don't feel to under pressure or behind the eight ball!

#SmallBizProud Video Highlight Reel: The Great State of Texas is Home to Amazing Small Businesses!

The second-largest state in the country, the great state of Texas is home to an adventuresome, can-do spirit. And, as we’re learning from the #SmallBizProud campaign, the “Friendship State” is a true friend to spirited small businesses of all kinds! From companies that reinvented the light switch (it’s shocking that it took so long, but not surprising that it took an entrepreneur to do it!) to immigration lawyers inspired to help others by their own experience, we’re nothing short of amazed by the small businesses that have planted their flag in the Lone Star state.

With so many exciting videos to choose from, we narrowed this week’s round-up to two husband & wife teams and two committed and passionate small business owners who wouldn’t give up. All of them wow us with their dedication, innovation and courage. Combine a childhood dream and savvy business sense with one couple’s can-do, go-for-it spirit, and you get one of the greatest business ideas on the road: PhotoMoto HTX. When Austin Havican and his wife, Brittany, a photographer, were struggling for a reason to justify buying a 1978 Volkswagen bus--a dream of Austin’s since childhood--Brittany brought a creative solution to the table. While shooting weddings, Brittany had noticed the popularity of photo booths, brought in and installed at receptions and had been wanting to expand her own photography business in that direction for some time. An idea was ignited: what about a mobile photo booth? The couple decided to go for it and buy the bus. With an article Austin had found about an Englishman in the 60’s who had built a photo studio in his double-decker bus, Austin got to work transforming his four wheels into a photo studio. Today, PhotoMoto brings photo-fun to weddings, events, festivals and more. But what is the most rewarding part of the job for Austin? As much as he enjoys meeting new people, spreading the fun and earning a living at what he loves, his favorite part of his day is still cruising in his VW bus. Capital One #SmallBizProud HoustonLCD Concepts, Inc.: Houston, TX
There aren’t many small businesses whose favorite product story involves a stranded oil rigger submerged in the middle of the ocean. But for Nancy and Brian Olson, creating a product that can withstand harsh environments is their pride and joy. Their company, LCD Concepts, produces watertight screen monitors for use on sailboats and other vessels that can be trusted in the most trying of circumstances including hurricanes; currently, they are completing an order for the US Navy. Even more amazing? All their products are made by hand. A team of two, this couple is able to make it work by steering the business in the direction of what they do best. Nancy handles the sales and marketing side, and Brian gets his hands dirty with the mechanics in product development, a love of his since childhood.  As he says, "When I was 6 years old I was doing this stuff, creating and building and doing things with my hands." With LCD Concepts it’s been a plan for success and happiness from the get-go. Says Nancy,: "I love it. I enjoy the environment. We have such a vision, where the sky is the limit. Vi NanthavethLaw Office of Vi Nanthaveth: Austin, TX
The seeds of Vi Nanthaveth’s small business dream were planted when she was just a little girl. Born in Vientiane, Laos, Vi immigrated to the United States with her parents and spent time in a refugee camp before settling in a small town in Louisiana. During law school, she discovered immigration law, and it quickly became her passion. It wasn’t long before she decided to take the leap into starting her own law firm. At first, it was a shock; starting your own business, as she puts it, is something that no school can ever prepare you for, and she has “a few scars from learning along the way!” But she hung in there, and today feels that being small business proud is “in her blood” (both her parents were business owners back in her home country). Today, Vi loves the aspect of her job that allow her to meet and help different people and families from all walks of life in a truly rewarding career. AustinPLUM: Austin, TX
It takes the bold spirit of an entrepreneur to reinvent something that hasn’t changed for the last 100 years! Where some people only see a simple “on/off” switch, Utz Baldwin and his team saw one thing: change. Utz was working on starting a completely different company, a software company, when he decided to fast track the light switch into the 21st century and transform it to be wifi-smart. As Utz puts it, “intelligence and connectivity” is the “logical next step” for the light switch. And people agreed: PLUM beat out 77 other competitors in a Silicon Valley start-up competition and won the top honor of a million dollars in funding. They then launched themselves into the world crowd funding and raised over $300,000. Utz is grateful; he feels connected to “each and every one of the backers” and notes that their level of support and faith in his company is nothing short of profound.  It’s true that the percentage of start-ups that make it is 1%. But, as Utz says: “there’s a snowball’s chance in hell of making it, but we’re gonna make it—that’s the attitude of the entrepreneur. Drink More Good is a flavored syrup company based in Beacon, NY that was founded in 2012 after the founder, Jason Schuler, sent a pitch for funding via G-Chat to a friend. The syrups can be used for just about anything, including soda, seltzer, cocktails, and probably salad dressing if you wanted extra pizazz in your greens. Jason started with 25 flavors produced from herbs and spices, and within a year, produces and grows 100 flavors. During this time, Drink More Good has outgrown its production kitchen, is seen in every farmers market you want to shop in, is in talks with major wholesale accounts, and is building a new retail location to serve as part retail store and part production kitchen.

At this point of major growth, it's a perfect time to...change the packaging on the bottles. A major undertaking! And can be quite costly. However, during the first year of business, Jason got so many questions from customers, he knew he had enough market research to go to the drawing board and redesign the packaging. Jason often sits in the Drink More Good booth at farmers markets to serve customers, and had this to say about his packaging: "I wanted to talk less, and for the packaging on the bottles to answer more questions. When people ask me how to use the syrup, it eats away at my soul every time I hear it."

Determined and on a mission, Jason and his team wrote down all questions and comments they've received, and tried to address problem areas: the size of the bottle and the messaging on the printed label.

LARGER BOTTLE, DIFFERENT SHAPE
The bottle increased in size from 12oz to 12.7oz. They are even experimenting with lowering the cost of a bottle of syrup at farmers markets, since those venues easily trigger word of mouth marketing for the flavored syrup company.

The bottles themselves also created a lot of dripping as people poured the syrup into glasses or mixing bottles to make home-made soda. So the new bottle now has a narrow neck and more resemble a wine bottle.

RECIPES ON THE PRINTED PACKAGING
The new label now addresses usage questions, like "How do you use these?" It's wonderful to have a curious person interested in the product, but to get them to buy the product means that they need to crave the product. The bottle must generate the feeling of "I must have this in my pantry" or "My friend would really love this ingenious product".

So the bottles now have three recipes on the front of the label:

  • Home-Made Soda
  • Lightly Flavored Seltzer
  • Cocktail Mixer

When a bottle is all a person has of your product, and they are the ones that have to make the magic and create a drink from it, you want to empower them with the can-do spirit that they can keep making a drink from this bottle of syrup, and then buy more. The perfect place is on the packaging, which they won't lose and is easy to find every time.
